SimmonsConnect Privacy Policy

Simmons Research LLC ("we" or "Simmons") has formed the SimmonsConnect panel with the goal of providing research data that will provide insights that help U.S. businesses and college/university researchers better understand the impact of the Internet and mobile devices on our everyday lives. If you qualify for, and opt to join, any of three subpanels that reflect different types of devices by which individuals access the Internet, you will install a Research Application ("Research Application" or "Application") onto a qualified device. The three subpanels are the "PC Subpanel," "Smartphone Subpanel," and "Tablet Subpanel." The Smartphone Subpanel and the Tablet Subpanel are collectively referred to as the "Mobile Subpanels." The SimmonsConnect Panel and/or any one or more of the Subpanels are also referred to in this policy as a "Panel." Participants in a Panel are "Panelists."

This SimmonsConnect Privacy Policy describes the ways in which Personally Identifiable Information and other information is collected from you in connection with your participation in the Panel, as well as how Simmons uses and discloses such information. This Privacy Policy also describes our information practices with respect to your use of the SimmonsConnect website located at www.simmonsconnect.com (the "Site"). The Simmons Research LLC Privacy Policy also includes information about the collection, use and disclosure of information from the Panel and the Site. Personally Identifiable Information ("Personal Information") includes information about you that is personally identifying such as your first and last name, email address, home address including street name and town, and a phone number. Personal Information may include other types of information depending on the legal definition that applies in your physical location. Only the definitions of Personal Information that apply in your location will apply to you under this Privacy Policy.

Agreement

By using the Site or by participating in a Panel, you accept and hereby expressly consent to our collection, use and disclosure of your Personal Information in accordance with the terms of this Privacy Policy and the Simmons Research LLC Privacy Policy.

This Privacy Policy and the Simmons Research LLC Privacy Policy may change from time to time, so please check back periodically to ensure that you are aware of any changes in our processing of your Personal Information. If at any time in the future we plan to use Personal Information in a way that differs from this Policy or the Simmons Research LLC Privacy Policy (to the extent it applies), we will post those changes here and provide you the opportunity to opt-out of such differing uses. The opt-out may be on the Site and/or by other methods, in our sole discretion.

If you do not opt out, your continued use of the Site or participation in the Panel after such changes signifies your express consent to the changes.

United States of America: The Site is geared towards U.S. users only and is maintained in the U.S. By using the Site or by participating in a Panel, you authorize the transfer of your Personal Information to the U.S. if you reside outside the U.S, and your consent to its disclosure, storage and use in the U.S. as described in this policy.

Information We Collect From Panelists Who Participate in the Mobile Subpanels

If you install a Research Application onto a desktop personal computer, laptop, notebook, or netbook (each, a "PC"), the Application will automatically collect the following types of information related to your PC and your use of it, on an ongoing basis, for as long as the Application remains installed:

At the same time that it collects the categories of information described above, the Application also records the time and the device's precise or approximate geo-location.

Information We Collect From Panelists Who Participate in the PC Subpanel

How We Use and Disclose Information We Collect through Panels

When you participate in a Panel, we combine the information that we collect from your participation in the Mobile and/or PC Subpanels, and inferences that we draw from that information ("Panelist Data"), with information we have collected from you or other household members in connection with you or your household's participation in our other online and offline research studies ("Survey Data"), including Personal Information such as your name, address and email address. Panelist Data combined with Survey Data create "Panelist Survey Data." If Panelist Survey Data is later combined with your Personal Information it will be called "Identifiable Panelist Survey Data" in this policy.

We may supplement Identifiable Panelist Survey Data with information that we receive from third party sources - We analyze and use Identifiable Panelist Survey Data for our research purposes and to create reports for our clients.

We use your mobile phone number to send you electronic messages, including text messages to have you install, reinstall, or follow through with the Panel. By agreeing to this Privacy Policy and participating in a Panel, you expressly consent to receive text messages and other electronic messages from us, our parent company and affiliates. We do not share your mobile phone number with unaffiliated third parties.

We disclose Identifiable Panelist Survey Data to our clients, parent company and its affiliates for their business purposes including their direct marketing purposes. These entities may in turn disclose parts or all of your Identifiable Panelist Survey Data to other third parties. We have no control over the use or disclosure of your Personal Information by our clients, parent or affiliates. Our parent company is Symphony Technology Group.

We disclose Participant Survey Data and non-Personal Information to our clients for their business purposes, and to third party vendors who help us operate the Site.

We will disclose Personal Information in response to valid legal process, for example, in response to a court order, a subpoena or other legal request for information, and/or to comply with applicable legal and regulatory reporting requirements. We also may disclose Personal Information in response to a law enforcement agency's request or other request for information from the U.S. or other government entities, or where we believe it is necessary to investigate, prevent, or take action regarding illegal activities, suspected fraud, situations involving potential threats to the physical safety of any person, or to verify or enforce compliance with the policies governing our products and/or services and with applicable laws, or as otherwise required or permitted by law or consistent with legal requirements. We may use Personal Information to protect our rights, enforce our agreements, and enforce our Terms of Use.

In addition, we may transfer Personal Information to an entity or individual that acquires, buys, or merges with Simmons Research LLC or our Parent or Affiliates.

Information Practices with Respect to the Site, www.simmonsconnect.com

When you fill out our registration form "Let's Get Started," we collect your home address, phone number, email, age and the length of time you have lived at your home address. When you contact us by phone, email or regular mail, we collect your name, email address and/or phone number. When you log in as a member, we collect your Panelist ID and password to allow you to access the Panel.

If you participate in a sweepstakes, the collection and use of your information will be covered by the rules of the individual sweepstakes. If the sweepstakes rules do not include information about the collection, use and disclosure of Personal Information, then this Privacy Policy will apply to the information collected through the sweepstakes.

We may use Personal Information collected on or through the Site, with or without Panelist Data:

We may also use or disclose Personal Information as we believe to be necessary or appropriate: (a) under applicable law, including laws outside your country of residence; (b) to comply with legal process; (c) to respond to requests from public and government authorities, including public and government authorities outside your country of residence; (d) to enforce our terms and conditions; (e) to protect our operations or those of any of our affiliates; (f) to protect our rights, privacy, safety, or property, and/or that of our affiliates, you, or others; and (g) to allow us to pursue available remedies or limit the damages that we may sustain.

Third Party Sites

This Privacy Policy does not address, and we are not responsible for, the privacy or other practices of any third parties, including any third party operating any site to which this Site contains a link. The inclusion of a link on the Site does not imply endorsement of the linked site by us or by our affiliates.

Protection of Your Personal Information

We will take appropriate technical and organizational safeguards to protect Personal Information from theft, loss, and unauthorized access. We follow generally accepted standards to protect the Personal Information submitted to us, both during transmission and once we receive it. No method of transmission over the Internet, or method of electronic storage, is 100% secure, however. Therefore, we cannot guarantee its absolute security.

We will retain Personal Information for as long as necessary to compile the Survey Data. We will retain and use Personal Information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.

Children's Online Privacy

Our Site, the online Survey, and the online Simmons Studies are directed to individuals who are at least eighteen (18) years of age. We do not knowingly collect Personal Information from children online. If you believe your child has provided information to us online, please contact us using the information provided below.

We collect Identifiable Survey Data by mail from minors through the Kids & Teens Surveys. This information is treated the same as other information collected by the offline Survey. Please see the section above on the National Consumer Survey/National Hispanic Consumer Survey about the use and disclosure of Personal Information collected offline.

Your California Privacy Rights; California Do Not Track Disclosures

If you are a California resident, California Civil Code Section 1798.83 permits you to request information regarding the disclosure of your Personal Information by Simmons Survey or its subsidiaries to a third party for the third party's direct marketing purposes. You may request this information in writing using the information under "Contact Us" below.

Your browser may offer you a "Do Not Track" option, which allows you to signal to operators of websites and web applications and services (including behavioral advertising services) that you do not wish such operators to track certain of your online activities, over time and across different websites. We do not honor "Do Not Track" signals.

Access to Personal Information

When we collect Personal Information, we provide individuals with reasonable opportunities to access that data and correct it when it's inaccurate. To access, update or change your Personal Information, please contact us as described below.

We are not responsible for removing Personal Information from the lists of any third party who has previously been provided your information in accordance with this Policy.
